DMCA Policy

Alter Dieter Bohlen (referred to as "we", "us", or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we will respond promptly to claims of copyright infringement committed using the Alter Dieter Bohlen service or network that are reported to our designated Copyright Agent, identified below.

This policy describes the information that should be present in a DMCA Notice and a Counter-Notification. It is designed to make the process of reporting and resolving copyright infringement claims as clear and efficient as possible.

Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Alter Dieter Bohlen service, please send a written DMCA Notice of Infringement to our Copyright Agent containing the following information:

  1. Identification of the copyrighted work claimed to have been infringed: This must include a detailed description of the copyrighted work, such as the title of the work, and the author. If multiple copyrighted works are covered by a single notification, please provide a representative list of such works.
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled: This must include specific identification of the material and its location on the Alter Dieter Bohlen service (e.g., a URL to the specific page or content).
  3. Information reasonably sufficient to permit Alter Dieter Bohlen to contact the complaining party: This includes your name, mailing address, telephone number, and, if available, an email address.
  4. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Filing a DMCA Counter-Notification

If you believe that your content that was removed or disabled is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, you may send a DMCA Counter-Notification containing the following information to our Copyright Agent:

  • Identification of the material that has been removed or to which access has been disabled: This must include the URL or other specific location where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Alter Dieter Bohlen may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature.

Upon receipt of a valid Counter-Notification, we may restore the removed material or cease disabling access to it within 10 to 14 business days, unless the copyright owner files an action seeking a court order to restrain the user from engaging in infringing activity related to the material on our service.
